I was glad to see this. I'm hoping it causes Alterra to sweeten their renewal again. It also makes me wonder what ORDA will do. I think they will need to promise some kind of a rollover to 2021-22 in the event next season is disrupted.
I think it's all about cash flow, not lawsuits. The loss of spring skiing is pretty trivial compared to losses everywhere else in the economy. There must be billions or even trillion of dollars in abrogated or defaulted contracts and leases due to COVID. I don't think the courts (or juries) will find the loss of at most $1000 by mostly rich white guys to be worthy of consideration. If you can't bear that kind of loss, you probably shouldn't be skiing.
