I'm with ya Skimore....just because the kid (as benny would put it) "broke the golden rule" doens't mean accidents don't happen. |
There is one exception to the downhill skier has the right of way. If the skier / rider down the hill is stopped then they lose that right of way. They are then responsible to look up hill and check for on coming skiers / riders. At least once a day on the weekends I'm skiing along and some goober doesn't look up hill and starts skiing in front of me. Its even worse when they do this in the bumps and then start traversing across the hill shopping for turns.
A true measure of a person's intelligence is how much they agree with you.

Why, none, actually, but I'm always open for ideas. Hit me from behind on the slopes and put me in rehab for the winter, and you'll be first on the list.

In Thailand, if you are in an accident with a Thai person, you are responsble no matter who's fault it is. What a great law for the home team. This would be a good rule at ski areas too. If there's a wreck with a local, then it's the tourists' fault. I would never feel the need to yell, " On Your Left." Wait a minute... I never feel that need anyway.

His pix in the article told me this ^^^ I'm not one for suing but this morning I went for a quick one and out on my beloved WF and saw good ole HPD. He's in a sling cause someone hit him and broke his wrist. I did not get all the details but my first reaction was I want to punch the guy that hit HPD, punch em real hard!!

I have very mixed feelings about this. I too have been hit from behind by a snowboarder while skiing, and I also snowboard so I'm not blaming snowboarders in general. There is an inherant risk of contacting an injury while skiing. The day that this happened was opening today, only one trail was open and there was a limited snow surface. It was quite crowded. Certainly, it does not take much genius to realize that there was more risk that day than on other days. On the other side of the coin, when I was hit two years ago at White face, I did not suffer a broken scapula and a rotator cuff injury. If that is really what happened, I can understand the judge's anger. I think ultimately, I would have elected not to bring legal action, as the injuries will be covered by health insurance, and they really is little to gain as far as I can tell from a lawsuit. The only other point I have to add is that I believe last year out West a young girl was hit unders similar circumstances by a snowborder and was actually Killed. To the extent that this news and discussion may foster people being more careful and avoiding injuries in the future, that may be the only silver lining to this tale.

I'm not convinced that it's always the "uphill" skiers fault...
I've seen skier clock people starting out onto trails(expert) I've hit a guy(my only real accident ever) who came in on me from the side and behind on an angle.. Was coming down to the lift on Clairs at Hunter and was against the trees on the left. He wasn't checking speed and doing big GS turns - came in from behind and ended up in front of me and i tok his ass out... Cleaned his clock - total yard sale. I immediately got up and asked if he was OK or if he needed Ski Patrol - Who happened to see the whole thing from the Z Lift.. Guy was yelling at me "You have to watch out for the downhill skier!!!" I said "Dude... You weren't the downhill skier until you were in front of me" Ski patrol agreed... |
