I guess that technically, since the kid hit the guy, he's ultimately responsible, regardless of whether there was reckless behavior or not. Same basic idea if your car is parked in a parking lot, and someone else bangs into your car. Even though it was probably completely accidental, the guy who hit your car is responsible for the damage. I don't really see how this is any different.

That said, it appears that the guy who got hit in this particular case, is a low-life slimeball who's really just looking for a payday. His medical bills were covered ... let it go, and don't get ridiculous about the other stuff.
It's easy to be against something ... It's hard to be for something!

I think whomever is his opponent will be able to have a FIELD day with this!  If I was the insurance company, I would be asking for old records and making sure that there was a recent injury!

Was it stated anywhere he was out of control?

I like the statement "If you run into somebody, that means you're not in control."
What if the guy he hit completely cut across the the fall line when everyone else is skiing the trail as it should be.

Who hasn't seen this happen?

If the judge sues the kid's family, the insurer eventually will pay to settle.  Regardless of how strong a defense the kid has, the insurer will determine how much it will cost to go to trial and offer slightly less than that amount.  This happened to me.  My lawyer (paid by the insurer) agreed with me that we definitely would win at trial, but it wasn't my call.  I didn't like it one bit, but I understood how things work in the real world.

But it's not exactly comforting to have judges who understand the rules, know how to work them and seem devoid of ethics.
